1. Acceptance of Terms
By downloading, installing, or using the Livio mobile application ("App"), you agree to be bound by this User Agreement ("Agreement"). If you do not agree to these terms, do not use the App. This Agreement is between you and Livio Team ("we," "us," or "our").
2. Eligibility
You must be at least 17 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.
3. Accounts
To use certain features of the App, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information (Name, Username, Email).
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Notify us immediately if you discover any security breach.
4. Description of Service
Livio is an intelligent photo management tool that uses AI to organize your photos. You acknowledge that:
- The AI categorization is automated and may not be 100% accurate.
- You are responsible for verifying the organization of your photos.
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.
5. User Content
- Ownership: You retain all rights and ownership of the photos you upload to the App ("User Content").
- License to Us: By uploading User Content, you grant us a worldwide, royalty-free, non-exclusive license to process, host, and display your content solely for the purpose of providing the App's services to you (e.g., to categorize your photos). We do not use your content for marketing or training public AI models without your explicit consent.
6. User Conduct
You agree not to use the App to:
- Violate any applicable law or regulation.
- Infringe the rights of any third party.
- Upload content that is illegal, harmful, threatening, abusive, or defamatory.
- Attempt to reverse engineer or compromise the security of the App.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE AI FEATURES WILL BE ERROR-FREE OR THAT THE APP WILL BE UNINTERRUPTED.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LIVIO TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
11. Governing Law and Dispute Resolution
- Governing Law: This Agreement shall be governed by the laws of the jurisdiction of our principal place of business, without regard to its conflict of law principles.
- Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to this Agreement shall be settled by binding arbitration. You and Livio Team agree to waive any right to a trial by jury or to participate in a class action.
